This page explains how to tell us if you believe something on nestmade.shop infringes your copyright, and how we handle such notices under the United States Digital Millennium Copyright Act (DMCA). It also explains how someone whose content was removed can respond with a counter-notice. Our wider approach to trademarks and other rights is described in our Intellectual Property Policy. All notices go to support@nestmade.shop with the subject “DMCA notice”.
\n
\n
Copyright notices at a glance
\n
\n
Where to send a notice: support@nestmade.shop, subject “DMCA notice”, or by post to Nest Made, 5166 Onacrest Dr, Los Angeles, CA 90043, US.
\n
What to include: the six elements listed in section 2.
\n
First reply: within 24 hours on business days, confirming we received your notice.
\n
What we do: review the notice and, when it is complete, remove or disable access to the material identified.
\n
Counter-notices: possible when content was removed by mistake or misidentification, see section 5.
\n
Repeat infringers: accounts of repeat infringers are closed in appropriate circumstances.
\n
\n
\n
1. What this page covers
\n
Most of what you see on nestmade.shop is created by or for Nest Made: product designs, page text, layout, our logo and our own images. Some elements, such as fonts used in designs, may be licensed from others. Because our products are personalized with names, dates and photos that customers send us, we also receive content from customers for use in private orders. That content is never published on the website.
\n
This page is for copyright owners, or people authorised to act for them, who believe that material on nestmade.shop, or a product we offer, uses their copyrighted work without permission. Examples could include a photograph used on a product page, an illustration on a nursery print or text copied from another website. For trademark concerns, please see our Intellectual Property Policy instead.
\n
2. How to send a copyright notice
\n
To help us act quickly, your notice should be in writing and include all of the following:
\n
\n
Your signature: a physical or electronic signature of the copyright owner or of a person authorised to act on their behalf. Typing your full legal name at the end of an email is acceptable as an electronic signature.
\n
The copyrighted work: a description of the work you believe has been infringed, such as “my watercolour illustration of a sleeping fox, published on my website in 2024”, with a link to where it is published if possible.
\n
The material on our site: the exact web address (URL) of each page on nestmade.shop where the material appears, and a description of which element on the page you mean, so we can locate it.
\n
Your contact details: your name, postal address, telephone number and email address.
\n
A good-faith statement: a statement that you have a good-faith belief that the use of the material in the way complained of is not authorised by the copyright owner, its agent or the law.
\n
An accuracy statement: a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
\n
\n
Send the notice to support@nestmade.shop with the subject “DMCA notice”. If you prefer post, write to Nest Made, 5166 Onacrest Dr, Los Angeles, CA 90043, US, marked for the attention of copyright notices. Email is faster, because we are an email-only shop.
\n
A sample notice layout
\n
You do not have to use any particular wording, but a clear notice usually follows this order: who you are and that you own or represent the work; what the work is and where it is published; the nestmade.shop URLs and the element on each page; the good-faith and accuracy statements; your signature and contact details. Short, factual notices are easiest to act on.
\n
3. What happens after we receive a notice
\n
\n
How we process a copyright notice
\n
\n
\n
Step
\n
What we do
\n
Timing
\n
\n
\n
\n
\n
Acknowledgement
\n
We confirm by email that we received your notice
\n
Within 24 hours on business days
\n
\n
\n
Completeness check
\n
We check that the notice includes the required elements and that we can find the material
\n
Promptly after receipt
\n
\n
\n
Action
\n
For a complete notice, we remove or disable access to the material identified
\n
Promptly, once the notice is complete
\n
\n
\n
Informing the other party
\n
Where the material came from someone else, we tell them and send a copy of the notice
\n
When we act on the notice
\n
\n
\n
Counter-notice period
\n
If we receive a valid counter-notice, we follow the process in section 5
\n
As described in section 5
\n
\n
\n
\n
If your notice is missing information, we will tell you what is needed. We may not be able to act on an incomplete notice, but we will always explain why.
\n
4. Products and designs
\n
If your notice concerns a product design rather than a picture or text on a page, we stop offering the design while we review the notice. We do not continue to sell a design that has been the subject of a complete notice unless the matter is resolved, for example by a valid counter-notice or by your written confirmation that the use is authorised.
\n
Customers who have already ordered an affected design are not asked to return it because of a notice, and their orders are handled in line with our normal policies. If a customer’s open order is affected, we contact them, explain the situation and offer an alternative design or a full refund.
\n
5. Counter-notices
\n
If material you provided was removed and you believe this happened because of a mistake or misidentification, you may send a counter-notice. It should be in writing to support@nestmade.shop with the subject “DMCA counter-notice” and include:
\n
\n
your physical or electronic signature;
\n
a description of the material that was removed and where it appeared before removal;
\n
a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
\n
your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Nest Made may be found), and that you will accept service of process from the person who provided the original notice or their agent.
\n
\n
When we receive a complete counter-notice, we send a copy to the person who submitted the original notice. If they do not tell us within the period set by the DMCA that they have filed a court action to restrain the alleged infringement, we may restore the removed material.
\n
6. Misuse of the notice process
\n
Please only send a notice if you are confident that material infringes your copyright. Under the DMCA, a person who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages, including costs and legal fees. If you are unsure whether a use infringes your rights, for example if it might be a fair use or the material may be licensed, consider seeking legal advice before sending a notice. You are also welcome to email us informally first; many questions can be answered without a formal notice.
\n
7. Repeat infringers
\n
Where customers have accounts on nestmade.shop, we may close the accounts of people who are found to have repeatedly infringed the copyrights of others, in appropriate circumstances.
\n
8. Customer content sent for personalization
\n
Customers sometimes send photos or text for a private order, for example a family photo or a short poem for a keepsake. This content is used only for that order, is not published on our website, and photos are deleted 30 days after delivery, as described in our Privacy Policy. Our Terms of Service ask customers to send only content they have the right to use. We decline personalization requests that clearly use another company’s trademarks, characters or artwork. If you believe a customer order uses your work, contact us with the details you have and we will look into it.
\n
9. Copyright owners outside the United States
\n
The DMCA process on this page is a United States law procedure, and Nest Made is based in California. If you are a rights holder in Canada, Australia, New Zealand or elsewhere, you are welcome to use the same process, and we will handle your notice in the same way. If you are relying on a law of your own country, please say so in your notice so that we can consider it.
\n
10. Fonts, illustrations and stock elements
\n
Personalized nursery pieces depend heavily on lettering. The typefaces used in our designs are used under the licence terms that apply to them, and any illustrations or decorative elements in our designs are either created for Nest Made or used under a licence that permits that use. If you are a type designer or illustrator and believe one of your works appears in a Nest Made design beyond what a licence allows, please tell us which design, which font or element, and where your licence terms are published. We will review the licence and our records and reply with what we find, even if the issue turns out to be covered by a licence.
\n
11. Keeping records
\n
We keep a record of every copyright notice and counter-notice we receive, the steps we took and the dates, for as long as needed to handle the matter and any follow-up. Notices may be shared with the person whose material was removed, as described above, so please only include contact details you are comfortable sharing for that purpose. We do not publish notices on our website.
\n
12. Informal questions before a notice
\n
Not every concern needs a formal legal notice. If you simply think an image looks like yours, or a design reminds you of your work and you would like to know where it came from, send us a friendly email with a link. We will look at it with you and explain what we know. If the conversation shows that a formal notice is appropriate, you can still send one at any time, and nothing in an informal exchange affects your rights.
\n
13. Questions
\n
For questions about this page, email support@nestmade.shop. For general enquiries, visit our Contact Us page or Submit a Ticket.
